On Friday, December 17, the Sixth Circuit Court of Appeals dissolved the previous court’s stay of OSHA’s Vaccination and Testing Emergency Temporary Standard for private employers. This affects businesses with 100 or more employees. Read our bulletin below for more information.

Wednesday, December 15, the Fifth Circuit Court of Appeals affirmed a preliminary injunction that temporarily blocks Centers for Medicare and Medicaid Services (CMS)’s vaccination mandate that applies to health care providers. However, the injunction does not apply nationwide.

The vaccination mandate is blocked in 24 states including Alabama, Arkansas, Georgia, Kentucky, Louisiana, Mississippi, Missouri, South Carolina and several others. Additional litigation is pending.
 
OSHA’s recent announcement applies to private employers and health care providers. Safer Federal Workforce Task Force (SFWTF) work sites are not addressed in this communication.
