On January 13, 2021, OSHA announced increases in civil penalty amounts that become effective January 15, 2021.
This increase is required under the Congressional Federal Civil Penalties Inflation Adjustment Act. State Occupational Safety and Health Plans, such as IN, KY, MN, NC, SC, TN, UT, VA and others, must adopt maximum penalty levels that are at least as effective as Federal OSHA’s.
Penalty amount increases are as follows:
- The maximum penalties for Serious or Other Than Serious increase from $13,494 to $13,653.
- The maximum penalties for Willful or Repeat Violation increase from $134,937 to $136,532.
Remember, these are maximum penalty amounts that can be applied per citation, not the average penalty amount per citation.
