​Most OSHA citation penalties are based on a severity and probability scale. When an OSHA Compliance officer visits your business and discovers a safety issue, they will explain what they found before leaving. The compliance officer does not levy the penalty, but they do explain the issue and circumstances to a member of management who then determines the penalty.
